The main purpose of the Department's activity is to ensure compliance with the law in the activities of the university, protection of the interests of the university, employees and students in judicial and state bodies, compliance with the norms of the current legislation of the Republic of Kazakhstan.

The main purpose of the Department is the organization, management and control of legal work in the activity of the non-commercial joint-stock company "South Kazakhstan Pedagogical University named after Ozbekali Zhanibekov" (hereinafter - the Organization).

 

To realize the main goal, the Department is assigned certain tasks and functions:

1) Task: ensuring legality in the Organization's activities.

Function:

- plans the activities of the Department, performs management functions aimed at high-quality and effective performance of tasks assigned to the Organization;

- analyzes information and other materials about legal work, prepares analytical reports on them, submits questions for consideration to the officials of the Organization, takes measures to eliminate identified shortcomings and improve legal work within the scope of competence;

- considers the appeals of individuals and legal entities on issues within the competence of the Department.

2) Task: protection of property and other interests of the Organization by legal means.

Function:

- represents the interests of the Organization in the established order in state bodies, courts, and other organizations when considering legal issues of the Organization's activities;

- organizes claim work and analyzes its condition.

3) Task: legal examination of contracts concluded by the Organization.

Function:

- participates in the development of contracts, carries out methodical management of contractual work;

- takes measures to ensure the timely and correct conclusion of contracts, accounting for the fulfillment of contractual obligations, and the application of liability measures to suppliers of goods, works or services who have not fulfilled their contractual obligations in an inappropriate manner.

4) Task: participation in the development of draft normative acts of the Organization and other documents on legal issues.

Function:

- on the instructions of the Chairman of the Board-Rector develops normative acts on legal issues within the competence of the Organization;

- verifies that the projects of legal acts initiated by the Organization comply with the requirements of the legislation, inspects them, and in cases of their non-compliance with the current legislation, makes proposals to eliminate the identified remarks within the established period;

- conducts a legal examination of draft orders of the Chairman of the Board-Rector, as well as within the competence of the Department of Documentation on activities of the structural divisions of the Organization;

- on behalf of the Chairman of the Board-Rector, he takes part in the review of draft normative legal acts developed by state bodies and organizations, which have been submitted to the Organization for approval;

- prepares reports on the legal work of the Organization;

- develops qualification requirements and job instructions for employees of the Department.

5) Task: Explanation of the current legislation of the Republic of Kazakhstan, organization of general education.

Function:

- takes measures to organize legal education in the Organization;

- convenes meetings and conducts seminars in the established order;

- on behalf of the Chairman of the Board-Rector prepares informational materials on the current legislation.

6) Task: Generalization of the practice of the legislation.

Function:

- monitors normative legal acts of the Republic of Kazakhstan on issues within the competence of the Department;

- organizes a systematized electronic record of normative legal acts submitted to the Organization of the Republic of Kazakhstan.
